In a recent press release, Simmerman Law Office, PLLC was noted as filing a Complaint in the Circuit Court of Monongalia County, West Virginia on behalf of Greer Industries, Inc. against the City of Morgantown, West Virginia alleging various violations of state law, sounding primarily in state preemption and violations of the West Virginia Constitution.  Having prevailed in the Circuit Court of Monongalia County, West Virginia on behalf its client, the West Virginia Supreme Court confirmed that the City of Morgantown, West Virginia’s actions were improper, in affirming the Circuit Court’s findings entered in favor of Greer Industries, Inc.
