COMPLAINT FILED AGAINST WEST VIRGINIA UNIVERSITY ALLEGING FRAUD AND COLLUSION IN THIRD TIER MEDIA RIGHTS PROCUREMENT DISPUTE

Per a recent press release, Simmerman Law Office, PLLC recently filed a lawsuit in Morgantown, West Virginia on behalf of West Virginia Radio Corporation against West Virginia University, WVU President Jim Clements, Oliver Luck, WVU Board of Governors Chairman Andrew Payne, Bray Cary, and other parties, claiming that Oliver Luck and Andrew Payne conspired to rig the bidding for West Virginia University’s third-tier media rights package, media rights primarily associated with WVU Athletics – to the detriment of West Virginia Radio Corporation.

The suit charges Oliver Luck with “improperly, incompetently, and unlawfully managing the media rights RFP process,” and West Virginia Radio Corporation claims West Virginia University subsequently tailored the second media rights RFP “to render WV Media’s partner, IMG College, the only qualified bidder, thereby transforming the RFP process into a sham.”

As stated in the Complaint, West Virginia Radio Corporation alleges that “these blatant and unlawful actions are not the result of inadvertence or errors made in good faith, but instead are the purposeful result of a fraudulent scheme to benefit WV Media, a corporation certain defendants own, or to personally enrich themselves or friends.”
